Analysis: Italy's Monti struggles as Berlusconi takes revenge

ROME (Reuters) - Little more than a year ago Silvio Berlusconi was hounded out of office by a baying crowd and economics professor Mario Monti stepped in as prime minister, hailed as Italy's savior.

Now Berlusconi has performed an astonishing comeback to return to the spotlight, exacting his political revenge while Monti is struggling badly to make a breakthrough in the campaign for a February 24-25 election.

For most of 2012 Monti, a former European commissioner, dominated Italy, pushing politicians to the sidelines and restoring the country's battered reputation after Berlusconi had taken the country to the brink of a Greek-style crisis.

Monti, already a Brussels insider, was feted in European halls of power for his austerity policies after the banishing of Berlusconi. Businessmen clamored for him to stand for a second term.

But since Monti responded to huge domestic and international pressure in December and dived into Italy's murky politics as leader of a centrist coalition, his trajectory has flattened as Berlusconi and other seasoned politicians strike back.

"Monti is not a politician at all. He was good at trying to govern this complicated country but he is definitely unable to campaign," said Gianfranco Pasquino, a political science professor at Bologna University.

"A professor of economics who has spent all his life in European activities, or teaching, or giving advice to banks cannot become a good campaigner in less than a month."

Monti's popularity has fallen from 70 percent when he took over as premier in November 2011 to as low as 30 percent now.

His failure to gain traction is down to a combination of factors including the extreme difficulty of occupying the centre in Italy's bipolar system and the short time he had to campaign.

But he has also made errors including a bad choice of allies, that reveal his lack of political experience, while his popularity with foreign leaders is a hindrance rather than boon in the campaign, prompting him this week to sharply tell EU officials to stop intervening on his behalf.

In fact it is arguable that Monti may have had a greater chance of influencing Italy's future if he had not entered the campaign at all and remained above the fray to line himself up as state president or another independent role.

"He has lost his political virginity and cannot be used any more as an impartial savior," said Professor James Walston of Rome's American University.

BERLUSCONI COMEBACK

Berlusconi's trajectory has been in the opposite direction. After withdrawing to the shadows for much of 2012, by the autumn he looked like an old, weary man, pushing his PDL party towards disintegration by his indecision.

But the billionaire showman has staged an extraordinary bounce-back in the last month, blitzing television programs in a remarkable display of media savvy and stamina for a man of 76.

"It was a great surprise. I didn't believe he was capable of it at his age ... On the technical level of communication he is very good," said prominent pollster Renato Mannheimer.

Despite being harried by a lurid sex scandal, Berlusconi has added from three to five percentage points to his People of Freedom party's support - some polls say more - although his progress has now slowed and may have peaked.

With the centre-left parties hanging on to a clear lead, there still seems only a small chance that Berlusconi will win the election, experts say, and he is fighting a bitter battle with Monti to control the balance of power.

While it is undoubted that Berlusconi has revived the centre-right, Monti has struggled to meet extravagant expectations that he could sweep away a deeply discredited political system and set Italy on a radical new path of renewal.

Support for his centrist alliance looks stuck around 15 percent, well short of his target of 20 percent. "He will get even less than 15 percent," Maurizio Pessato, vice president of SWG polling company, told Reuters.

Monti is under threat for third place from the anti-establishment 5-Star Movement of Beppe Grillo, the comedian who has exploited deep voter anger over Monti's taxes, economic hardship and a string of political scandals.

The raging scandal over the world's oldest bank, Monte dei Paschi di Siena, has hurt the center-left Democratic Party with which it has historic links, but also damaged Monti, seen by some voters as a member of an elitist financier class.

As a technocrat savior, Monti's aloof, professorial manners incurred respect, but they are much less suited to the cut and thrust of politics.

POLITICAL MASTER

In contrast, Berlusconi is a political master, with enviable communications skills and an ability with a ready quip to exploit his image among many conservative voters as a lovable rogue.

Monti seems to have difficulty finding the right tone, veering between his trademark "English" politeness and aggressively attacking his opponents while never departing from a dry monotonous tone, earning a nickname among some politicians as "Dr Jekyll and Mr Hyde."

He called Berlusconi a Pied Piper tricking Italians. Berlusconi shot back that Monti would try to tax his flute.

"Monti's biggest error is to have changed his style. To start criticizing his opponents using words that do not really belong to the lexicon of a competent technocrat, that an austere professor of economics should not say," said Pasquino.

Berlusconi has attracted support with a constant mantra of attacking the "little professor" over a hated housing tax and calling him a puppet of German Chancellor Angela Merkel.

But whereas Monti is seen as justified in giving as good as he gets from Berlusconi, his attacks on the mild mannered centre-left leader Pier Luigi Bersani, especially over Monte dei Paschi, often sound sour and could be counterproductive.

Monti's suggestions that Bersani is dominated by the unions, should "clip the wings" of extremists and dump his leftist ally Nichi Vendola because he would spook markets have pushed even the centre left leader into angry responses.

This could be damaging because Monti's best hope is to win enough power to oblige Bersani to invite him into a coalition government - something which advances by Berlusconi in the Senate could ironically make more likely.

Monti's real mistake may be that he took on a near impossible task, trying to turn Italian politics upside down in barely two months after launching his bid too late, and making a fundamental mistake in how he chose his allies.

Monti announced he would stand in December with his heterogeneous civil list allied to the centrist UDC of Pier Ferdinando Casini and the FLI of Gianfranco Fini.

Allying with Casini, who has barely got above 5-6 percent of the vote in 20 years in politics, and house speaker Fini who commands even less, may have been a fatal error because it blew Monti's chances of appearing as something radically new.

"Proposing himself as different from the others and from outside politics is denied by the fact that he is allied with two representatives of very old politics," Pessato said.

He said Monti and his political outsider backers, including Ferrari boss Luca Cordero di Montezemolo, "should have had the courage to go for it without getting in the same boat as Fini and Casini. They were too timid, both Monti and Montezemolo."

But even without these mistakes, Monti would have faced a desperately uphill task to change the postwar Italian division between a broad right and broad left.

"He found himself trying to navigate in the centre of a canal without getting too close to either bank ... his position was very, very difficult," Pessato said.

Facebook earnings beat expectations

Social media giant Facebook reported earnings and revenue that beat expectations on Wednesday but its operating margin fell sharply.

The stock bobbed between positive and negative in after-hours trading following the earnings announcement. (Click here to get the latest quotes for Facebook.)

During the fourth quarter, net income fell sharply to $64 million from $302 million in the year-ago quarter.

Excluding share-based compensation and related payroll tax expenses, and income tax adjustments, Facebook's profit was $426 million, or 17 cents per share, compared to $360 million for the same quarter in the prior year.

Revenue increased to $1.59 billion from the $1.13 billion a year ago it reported in its regulatory filings with the U.S. Securities and Exchange Commission before the company's initial public offering in May 2012.

Facebook's operating margin shrunk to 33 percent on a GAAP basis in the fourth quarter, compared to 48 percent a year ago.

Facebook said its mobile monthly active users jumped 57 percent to 680 million as of December 31, 2012. For the first time, the company said its mobile daily active users exceeded web daily active users.

During the quarter, mobile revenue, a closely watched figure, represented approximately 23 percent of advertising revenue, up from about 14 percent of advertising revenue in the third quarter of 2012

Facebook has ramped up its online advertising services in recent months, putting a greater emphasis on mobile ads and introducing capabilities that let marketers target Facebook users based on their Web browsing history.

In recent months, Facebook stock has rebounded, surging more than 75 percent from its all-time lows due in part to increased investor optimism about the company's ability to monetize its mobile user base. Despite the sharp uptick, shares are still trading below the company's IPO price of $38.

(AP) ? Side by side, leading Democratic and Republican senators pledged Monday to propel far-reaching immigration legislation through the Senate by summer providing a possible path to citizenship for an estimated 11 million people now in the U.S. illegally.

The senators acknowledged pitfalls that have doomed such efforts in the past, but they suggested that November's elections ? with Hispanics voting heavily for President Barack Obama and other Democrats ? could make this time different.

Passage of the emotionally charged legislation by the Democratic-controlled Senate is far from assured, and a taller hurdle could come later in the House, which is dominated by conservative Republicans who've shown little interest in immigration overhaul. Obama will lay out his own proposals Tuesday, most of which mirror the Senate plans.

Besides the citizenship provision, including new qualifications, the Senate measure would increase border security, allow more temporary workers to stay and crack down on employers who would hire illegal immigrants. The plans are still short on detail, and all the senators conceded that months of tedious and politically treacherous negotiations lie ahead.

But with a re-elected Obama pledging his commitment, the lawmakers argued that six years after the last sustained congressional effort at an immigration overhaul came up short in the Senate, chances for approval this year are much better.

"Other bipartisan groups of senators have stood in the same spot before, trumpeting similar proposals," said Sen. Charles Schumer, D-N.Y. "But we believe this will be the year Congress finally gets it done. The politics on this issue have been turned upside down," Schumer said, arguing that polls show more support than ever for immigration changes and political risk in opposing it.

"Elections. Elections," said Sen. John McCain, R-Ariz. "The Republican Party is losing the support of our Hispanic citizens. And we realize that there are many issues on which we think we are in agreement with our Hispanic citizens, but this is a pre-eminent issue with those citizens."

Obama got 71 percent of the Latino vote in November compared to 27 percent for Republican Mitt Romney.

The president will endorse the Senate process during an event in Las Vegas Tuesday, administration officials said. He will outline a similar vision for overhauling the nation's immigration laws, drawing on the immigration "blueprint" he first released in 2011.

The blueprint focuses on four key areas: a pathway to citizenship for the 11 million illegal immigrants in the U.S., improved border security, an overhaul of the legal immigration system and making it easier for businesses to verify the legal status of workers.

Seeking to ramp up pressure on lawmakers, the White House has prepared formal immigration legislation that it could sent to Capitol Hill should the Senate process stall, administration officials said. The officials spoke on the condition of anonymity in order to discuss internal strategy.

Like the president's blueprint, the Senate proposals also call for a path to citizenship for illegal immigrants already here. But lawmakers want the creation of that pathway to be contingent upon securing the border and better tracking of people in the U.S. on visas.

The Senate's five-page framework also calls for overhauling the legal immigration system, including awarding green cards to immigrants who obtain certain advanced degrees from American universities, creating an effective high-tech employment verification system to ensure that employers do not hire illegal immigrants in the future and allowing more low-skill and agricultural workers.

In a sign of the challenges ahead, the proposals immediately got a cool reaction from Senate Republican Leader Mitch McConnell of Kentucky.

"This effort is too important to be written in a back room and sent to the floor with a take-it-or-leave it approach," McConnell said. "It needs to be done on a bipartisan basis and include ideas from both sides of the aisle."

Sen. Jeff Sessions, R-Ala., said on the Senate floor, "No one should expect members of the Senate are just going to rubber-stamp what a group has met and decided."

Sen. Ted Cruz, R-Texas, said he was concerned about the proposed path to citizenship.

"To allow those who came here illegally to be placed on such a path is both inconsistent with rule of law and profoundly unfair to the millions of legal immigrants who waited years, if not decades, to come to America legally," said Cruz.

A year after Border Patrol apprehensions of illegal border crossers plunged to the lowest levels in nearly 40 years agents have seen a slight increase in arrests, according to Border Patrol arrest data obtained by The Associated Press. In the budget year that ended in September, Border Patrol agents arrested 356,873 would-be border crossers along the Mexican border. In fiscal year 2011, agents along the Mexican border made 327,577 arrests.

Senate Majority Leader Harry Reid, D-Nev., applauded the framework and said, "I will do everything in my power to get a bill across the finish line."

Pressures from outside groups from business to organized labor to immigrants themselves will be immense, even as lawmakers warily eye voters for their reaction.

Besides McCain and Schumer, the senators endorsing the new principles Monday were Democrats Dick Durbin of Illinois, Robert Menendez of New Jersey and Michael Bennet of Colorado and Republicans Lindsey Graham of South Carolina, Marco Rubio of Florida and Jeff Flake of Arizona.

Several of them have worked for years on the issue. McCain collaborated with the late Democratic Sen. Edward M. Kennedy on the comprehensive immigration legislation pushed by then-President George W. Bush that failed in 2007.

The group claims a notable newcomer in Rubio, a potential 2016 presidential candidate whose conservative bona fides may help smooth the way for support among conservatives wary of anything that smacks of amnesty. Rubio has been working with the group while also detailing his own similar immigration proposals to selected media, getting a generally positive reaction from conservative media.

"There are 11 million human beings in this country today that are undocumented. That's not something that anyone is happy about; that's not something that anyone wanted to see happen, but that is what happened. And we have an obligation and the need to address the reality of the situation that we face," Rubio said Monday.

As the group turns to the work of writing legislation, which they hope to see come to a vote in the Senate Judiciary Committee in March, there may be most disagreement over the path to staying in the U.S. legally. In order to satisfy the concerns of Rubio and other Republicans, the senators are calling for the completion of steps on border security and oversight of those here on visas before taking major steps forward on the path to citizenship.

Even then, those here illegally would have to pass background checks and pay fines and taxes in order to qualify for a "probationary legal status" that would allow them to live and work here ? and not qualify for federal benefits ? before being able to apply for permanent residency, a critical step toward citizenship. Once they are allowed to apply they would do so behind everyone else already in line for a green card within the current immigration system.

That could be a highly cumbersome process, but how to make it more workable is being left to future negotiations. The senators envision a more streamlined process toward citizenship for immigrants brought here as children, and for agricultural workers.

Outside groups including Latino advocacy organizations, the U.S. Chamber of Commerce and organized labor were quick to praise the emerging framework. But some also sounded notes of caution.

Richard Trumka, president of the AFL-CIO, questioned a proposal by the Senate group to require illegal immigrants to provide proof of employment before they can gain legal status. Trumka said it could exclude millions of workers "who cannot prove employment because they have been forced to work off the clock or have no employer by virtue of being independent contractors."

Deepak Bhargava, executive director of the Center for Community Change, questioned the process being set out for the path to citizenship. "If the details are not done correctly, the path to citizenship can take far longer than it is reasonable. There is real concern about those details," he said.

New research suggests that increased consumption of foods containing colorful carotenoids, particularly beta-carotene and lutein, may prevent or delay the onset of amyotrophic lateral sclerosis (ALS). The study, published by Wiley in Annals of Neurology, a journal of the American Neurological Association and Child Neurology Society, found that diets high in lycopene, beta-cryptoxanthin, and vitamin C did not reduce ALS risk.

Carotenoids give fruits and vegetables their bright orange, red, or yellow colors, and are a source of dietary vitamin A. Prior studies report that oxidative stress plays a role in the development of ALS. Further studies have shown that individuals with high intake of antioxidants, such as vitamin E, have a reduced ALS risk. Because vitamin C or carotenoids are also antioxidants, researchers examined their relation to ALS risk.

According to the National Institutes of Neurological Disorders and Stroke (NINDS) roughly 20,000 to 30,000 Americans have ALSalso known as Lou Gehrig's diseaseand another 5,000 patients are diagnosed annually with the disease. ALS is a progressive neurological disease that attacks nerve cells (neurons) in the brain and spinal cord, which control voluntary muscles. As the upper and lower motor neurons degenerate, the muscles they control gradually weaken and waste away, leading to paralysis.

"ALS is a devastating degenerative disease that generally develops between the ages of 40 and 70, and affects more men than women," said senior author Dr. Alberto Ascherio, Professor of Epidemiology and Nutrition at Harvard School of Public Health in Boston, Mass. "Understanding the impact of food consumption on ALS development is important. Our study is one of the largest to date to examine the role of dietary antioxidants in preventing ALS."

Using data from five prospective groups: the National Institutes of Health (NIH)AARP Diet and Health Study, the Cancer Prevention Study II-Nutrition Cohort, the Multiethnic Cohort, the Health Professionals Follow-up Study, and the Nurses' Health Study, researchers investigated more than one million participants for the present study. A total of 1093 ALS cases were identified after excluding subjects with unlikely food consumption.

The team found that a greater total carotenoid intake was linked to reduced risk of ALS. Individuals who consumed more carotenoids in their diets were more likely to exercise, have an advanced degree, have higher vitamin C consumption, and take vitamin C and E supplements. Furthermore, subjects with diets high in beta-carotene and luteinfound in dark green vegetableshad a lower risk ALS risk. Researchers did not find that lycopene, beta-cryptoxanthin, and vitamin C reduced the risk of ALS. Long-term vitamin C supplement intake was also not associated with lower ALS risk.

Dr. Ascherio concludes, "Our findings suggest that consuming carotenoid-rich foods may help prevent or delay the onset of ALS. Further food-based analyses are needed to examine the impact of dietary nutrients on ALS."

New research suggests that increased consumption of foods containing colorful carotenoids, particularly beta-carotene and lutein, may prevent or delay the onset of amyotrophic lateral sclerosis (ALS). The study, published by Wiley in Annals of Neurology, a journal of the American Neurological Association and Child Neurology Society, found that diets high in lycopene, beta-cryptoxanthin, and vitamin C did not reduce ALS risk.

Carotenoids give fruits and vegetables their bright orange, red, or yellow colors, and are a source of dietary vitamin A. Prior studies report that oxidative stress plays a role in the development of ALS. Further studies have shown that individuals with high intake of antioxidants, such as vitamin E, have a reduced ALS risk. Because vitamin C or carotenoids are also antioxidants, researchers examined their relation to ALS risk.

According to the National Institutes of Neurological Disorders and Stroke (NINDS) roughly 20,000 to 30,000 Americans have ALSalso known as Lou Gehrig's diseaseand another 5,000 patients are diagnosed annually with the disease. ALS is a progressive neurological disease that attacks nerve cells (neurons) in the brain and spinal cord, which control voluntary muscles. As the upper and lower motor neurons degenerate, the muscles they control gradually weaken and waste away, leading to paralysis.

"ALS is a devastating degenerative disease that generally develops between the ages of 40 and 70, and affects more men than women," said senior author Dr. Alberto Ascherio, Professor of Epidemiology and Nutrition at Harvard School of Public Health in Boston, Mass. "Understanding the impact of food consumption on ALS development is important. Our study is one of the largest to date to examine the role of dietary antioxidants in preventing ALS."

Using data from five prospective groups: the National Institutes of Health (NIH)AARP Diet and Health Study, the Cancer Prevention Study II-Nutrition Cohort, the Multiethnic Cohort, the Health Professionals Follow-up Study, and the Nurses' Health Study, researchers investigated more than one million participants for the present study. A total of 1093 ALS cases were identified after excluding subjects with unlikely food consumption.

The team found that a greater total carotenoid intake was linked to reduced risk of ALS. Individuals who consumed more carotenoids in their diets were more likely to exercise, have an advanced degree, have higher vitamin C consumption, and take vitamin C and E supplements. Furthermore, subjects with diets high in beta-carotene and luteinfound in dark green vegetableshad a lower risk ALS risk. Researchers did not find that lycopene, beta-cryptoxanthin, and vitamin C reduced the risk of ALS. Long-term vitamin C supplement intake was also not associated with lower ALS risk.

Dr. Ascherio concludes, "Our findings suggest that consuming carotenoid-rich foods may help prevent or delay the onset of ALS. Further food-based analyses are needed to examine the impact of dietary nutrients on ALS."

The 87-year-old actor, best known for the 1960s hit comedy "The Dick?Van?Dyke Show" and Disney's big-screen musical "Mary Poppins," can now add lifetime achievement honoree. He picked up that honor at Sunday night's 19th annual Screen Actors Guild Awards.

"I've knocked around in this business for 70 years and I still haven't quite figured out exactly what it is I do," Van?Dyke said after accepting his trophy from presenter Alec Baldwin.

"The years have been full of surprises for me and a lot of fun. Aren't we lucky to have found a line of work that doesn't require growing up?"

Van?Dyke's career has spanned eight decades, starting with work as a disc jockey and a standup comic in the late '40s. He even worked as a national television morning-show host, with no less than Walter Cronkite serving as his news anchor.

But perhaps Van?Dyke's most critical career break came in 1960, when director Gower Champion hired him as the male lead opposite Chita Rivera in the new Broadway-bound stage musical "Bye Bye Birdie."

Van?Dyke had no professional dance experience, and out-of-town tryouts did not go well. Nevertheless, Champion refused to fire the actor, who would go on to New York with Rivera and win a Tony award for his performance.

About a year later, Van?Dyke was starring in his own sitcom, in the role of TV comedy writer Rob Petrie on "The Dick?Van?Dyke Show." Three prime-time Emmys for Van?Dyke and more than 50 years later, the series remains revered by many critics as one of the earliest models of great workplace comedy.

"'The 'Dick?Van?Dyke Show' was the most fun I ever had and the most creative period of my life," he said on the red carpet.

During the series' run, Van?Dyke also enjoyed big-screen hits, including the 1963 "Birdie" movie and the 1964 all-star comedy, "What a Way to Go!" But biggest of all was "Mary Poppins," in which he introduced the Oscar-winning song "Chim Chim Cher-ee."

"I'm world-famous for my Cockney accent," Van?Dyke kidded in his acceptance speech. He has said his British-born co-star, Julie Andrews, told him he never got the accent right.

Van?Dyke also saluted the room full of actors who gave him a standing ovation.

"I'm looking at the greatest generation of actors in the history of acting. You've all lifted the art to another place now," he said. "Besides that you're everywhere. You're in Darfur, Somalia, Haiti. You're all over the place trying to do what's right.

"This very heavy object here means that I can refer to you as my peers. I'm a happy man, God bless."

Last year, Van?Dyke presented the same lifetime achievement honor to his former TV co-star, Mary Tyler Moore.

These days, Van?Dyke sings with his vocal group, The Vantasix, and enjoys life with his wife of one year, makeup artist Arlene Silver. The couple met seven years ago at the SAG Awards.

"They tell me you never work again once you get this award," Van?Dyke said on the red carpet. "I'll have to let them know I'm available."

Hackers Infect Government Websites with 'Asteroids' Game

Hackers angry over the suicide of Internet activist Aaron Swartz took over the website of the United States Sentencing Commission (USSC) twice over the weekend, finally infecting the homepage with a playable version of the classic arcade game "Asteroids."

The hackers, claiming affiliation with the online movement Anonymous, also claimed to release a list of people in the federal Witness Security Program, also known as the Witness Protection Program, but that was quickly discovered to be a hoax.

The attack began late Friday (Jan. 25), when the homepage of the USSC, which sets sentencing guidelines for federal courts, was defaced with a video regarding the prosecution of Swartz.

"We have seen the erosion of due process, the dilution of constitutional rights, the usurpation of the rightful authority of courts by the discretion of prosecutors," said a voiceover on the video. "We have seen how the law is wielded less and less to uphold justice, and more and more to exercise control."

Swartz, who hanged himself in his Brooklyn apartment earlier this month at the age of 26, was facing decades in federal prison for allegedly downloading millions of academic documents from an online archive to a laptop hidden on the campus of the Massachusetts Institute of Technology.

According to a report released last week, local authorities in Boston had not intended to seek any jail time for Swartz.

Federal prosecutors then took over the case, first indicting Swartz on four charges that carried a maximum penalty of 35 years in prison, then adding nine more charges in a second indictment that increased the possible prison time to 50 years.

Two weeks ago, Anonymous defaced the websites of MIT and the U.S. Department of Justice in Swartz's memory.

The USSC site was fixed Saturday (Jan. 26), but late Sunday the Twitter feed @OpLastResort issued a cryptic message.

"ussc.gov --> enter Konami code (with cursor keys) ???????? B A ---> CAEK (repeat for NyanCat powers...)"

The Konami cheat code was a well-known method of gaining extra points on the Nintendo Entertainment System in the 1980s. On a computer, it would be up-up-down-down-left-right-left-right on the keyboard arrow keys, then "B," "A" and "Enter."

On Sunday evening, the USSC site appeared normal until the cheat code was entered, at which point a silhouette of the popular Internet meme "NyanCat" appeared.

The arrow keys maneuvered NyanCat and fired his thruster engine; pressing the spacebar fired his laser cannon, blowing away elements of the page until a background image of the Anonymous logo appeared.

On Monday morning (Jan. 28), the USSC's site was unreachable, but the game had been ported to the website of the Eastern Michigan branch of the U.S. Probation Office at http://www.miep.uscourts.gov/.

Bill Ackman, the head of Pershing Square Capital Management and its $12 billion in assets, squared off against Carl Icahn, the fellow activist investor and one of the richest men in America with an estimated fortune of nearly $15 billion.

The debate revolved around charges and countercharges, with Icahn calling Ackman dishonest and "a major loser," while Ackman countered that Icahn is a bully "not used to someone standing up to him."

Traders at the New York Stock Exchange punctuated the air with "oohs" and "aahs" during the arguing, while social networks lit up, with financial journalists and market watchers tweeting and posting as fast as their fingers could type. (Read More:Ackman: Icahn Wanted to Be My Friend, I Said No)

The setting was during the final half-hour of CNBC's "Fast Money Halftime Report" with Scott Wapner, who found himself as much of the story as the two participants.

Icahn repeatedly berated Wapner. Icahn insisted he was the one being bullied and on several occasions used the word "bullsh--" to describe his feelings about the on-air forum.

"I've really sort of had it with this Ackman guy," Icahn said early on.

"Carl, you think I want to you invest with you?" Ackman charged later.

"I wouldn't invest with you if you were the last man on Earth!" Icahn bellowed in an exchange typical of the show's tenor.

At the core of the dispute was Icahn's furor with Ackman over the latter's short position on?Herbalife, the nutritional supplement and dietary product company that Ackman has called a pyramid scheme. (Read More:?Selling the American Dream, a CNBC Investigation)

In turn, Ackman released a statement Thursday that recalled a legal dispute between the two parties 10 years ago that resulted in Icahn having to pay Ackman's investors $4.5 million plus interest.

While each combatant scored style points during the battle, if the winner was to be declared from the performance of Herbalife, Icahn scored a clear victory.

The company's shares surged as much as $2.15 in the half-hour melee, though gains cooled afterwards.

Some other zingers:

From Ackman: "I was concerned about dealing with Carl Icahn, because Carl Icahn unfortunately does not have a good reputation for being a handshake guy."

Icahn: "He's the quintessential example that on Wall Street, if you want a friend, get a dog."

Ackman, again: "What I can tell you is, this is not an honest guy, and this is not a guy who keeps his word. This is a guy who takes advantage of little people."

And the Icahn counter: "I appreciate Bill that you called me a great investor. I thank you for that. Unfortunately I can't say the same for you."

Indeed, it was great theater.

Twitter lit up, with participants frantically posting updates.

"Move over Snooki and The Situation.. here comes CNBC's version of "Jerry Springer With Limos" (Hat tip Sir Arthur!!)," investor Doug Kass tweeted.

CNBC's own Jim Cramer, host of "Mad Money," wondered, "Whatever happened to the dignity of wealth!??"

And financial news site Business Insider simply labeled it "The Greatest Moment In Financial TV History."

Timeline: Fire in nightclub kills about 200 in Brazil

(Reuters) - Following the deaths of some 200 people in a fire at the Kiss nightclub in the Brazilian city of Santa Maria, below are some of the deadliest fires this century entertainment venues.

Among the worst fires in Brazil was at a circus in Niteroi in 1961 in which 323 people died after an arson attack. Among the deadliest ever fires at a nightclub was at the Cocoanut Grove in Boston on November 28, 1942, when 492 were killed.

This century, these fires have caused heavy casualties:

March 29, 2000 - Paradise video parlor, an illegal porn cinema, at Jiaozuo in China's Henan province. 74 dead.

December 25, 2000 - Mall at Luoyang, China; fire engulfs building workers and Christmas party at discotheque. 309 dead.

December 1, 2002 - La Coajira nightclub, Caracas. 50 dead.

February 20, 2003 - Station nightclub, West Warwick, Rhode Island; fireworks during heavy metal concert. 100 dead.

December 30, 2004 - Republica Cromagnon nightclub, Buenos Aires; flare for New Year party hits foam ceiling. 192 dead.

January 1, 2009 - Santika nightclub, Bangkok; New Year party. 61 dead.

December 5, 2009 - Lame Horse nightclub, Perm, Russia; indoor fireworks ignite wicker ceiling. At least 155 dead.

January 27, 2013 - Kiss nightclub, Santa Maria, Brazil; band had fireworks show. Police expect death toll to be over 200.

The state of small business lending | REJournals.com

The Small Business Administration recently finished its fiscal year, and it was a record year on most all accounts. During fiscal year 2012, more than $1 billion in SBA loans were approved for small businesses in the State of Illinois alone. This represents a substantial increase over 2011.

The impressive results in 2012 can be attributed in great part to business? appetite for attractively priced alternative financing options and the success of a two-year refinancing initiative that was part of the SBA 504 Loan program.

At the same time, since the end of September a powerful misconception has emerged and lingered in the market.? There are people?small business owners and those who advise them ? who believe that the Small Business Administration no longer is funding transactions ? that it is closed for business.

That couldn?t be farther from the truth.

Let?s clarify the state of small business lending as we close out calendar 2012 and look ahead to 2013.

Two years ago the Jobs Act of 2010 was ratified to provide small businesses with greater access to capital to invest in fixed assets. Through the SBA 504 lending program, small businesses finance the purchase, construction and renovation of commercial real estate (as well as the acquisition and installation of heavy machinery and equipment) through long-term, government-guaranteed loans.

The Small Business Jobs and Credit Act of 2010 enhanced the existing SBA loan program with three significant changes:

  • Greater access ? To qualify for a 504 loan, the tangible net worth of a company was increased to $15 million (from $8.5 million), while after-tax net income as high as $5 million (up from $3 million);
  • Increased loan values ? Applicants are eligible to receive between $5 million and $5.5 million in SBA dollars (up from between $1.5 million to $4.0 million); and
  • Debt refinancing ? Existing debt can be refinanced. Recent modifications removed certain restrictions and meant that refinancing of the debt would be possible regardless of the loan maturity.

The final change ? the refinance provision ? carried with it an expiration. The end of September brought about the end of the refinancing program.

Yet small business lending is alive and doing very well in Illinois, and across the country. The first two changes to the Jobs Act of 2010 remain in full force today. Those two characteristics, along with the fact that interest rates continue to be at some of the lowest levels ever, make SBA lending as attractive as ever.

In a traditional SBA 504 loan, a bank provides the first mortgage at 50 percent of the eligible financing, a Certified Development Corp. (CDC) like SomerCor provides a second mortgage equal to 40 percent of the eligible financing, and the borrower puts 10 percent down.? Conventional lending often calls for 25 to 35 percent down in this market, so the out-of-pocket savings is significant.

The current SBA lending programs provide advantages to both banks and borrowers.? For banks, it brings exposure down to 50 percent at a time when financial institutions are looking to preserve capital and keep their loan to values at conservative levels.? For business owners, rather than putting 25 to 35 percent down for a five-year conventional loan, the business owner can put down just 10 percent, and use the savings for working capital needs.

Additionally, the SBA portion of the 504 loan is a 20-year fixed rate that currently is 3.95 percent.

The three new elements of the legislation will impact business owners in a number of ways:

  • This increase in size standard requirements means that middle-market firms have greater access;
  • By increasing the amount of money that can be borrowed, the purchasing power of businesses has increased significantly, and the program can be utilized for projects as large as $15 million to $20 million.

Exemplifying the benefits and advantages of the SBA lending program, and the various changes that have taken place over time, is St. Charles-based Tek Pak Inc. Formed in 1992, Tek Pak sells, manufactures and distributes plastic carrier tape and thermoform prototype and production tooling to customers in the electronics and healthcare industries, among others.

Tek Pak Inc. has been the beneficiary of three SBA 504 loans, and is working on another.? Tony Beyer, president, said the SBA 504 program has allowed Tek Pak Inc. to continue to expand its operations.

Tek Pak Inc. first used a 504 loan four years ago to acquire its St. Charles facility.? ?Last year, the company used two new SBA 504 loans for equipment.? One of those loans led to the purchase of additional manufacturing equipment and the second was used to refinance term debt on other manufacturing equipment.

The company is currently in the process of obtaining its fourth 504 loan in order to acquire a facility in Batavia that it currently leases.?This new 504 loan will allow Tek Pak Inc. to continue to make capital expenditures, grow and hire additional employees.

Brands Running Ads On Vine - Business Insider

Urban Outfitters was the first big brand to run an ad on Vine, as far as we can tell from searching Twitter and media coverage of the launch of Twitter's ingenious new 6-second video app.

Vine was unveiled by Twitter on Jan. 24. By 6.07 p.m., UO had tweeted this Vine video of a couple of dogs, along with the sarcastic comment, "The most important Vine you'll ever see."

Ironically, if it indeed turns out to be the case that UO was the very first advertiser to promote itself through Vine, then it will actually have been a very important Vine.

The Family Handyman magazine's weblog shares a method for cutting two push sticks from a single sheet of ?" plywood. There are two types of push stick?a broad, flat stick for heavy boards where you need to apply extra pressure and a longer stick for narrow cuts and lighter boards. If you're a safety-conscious professional who always knows where your hands are in relation to a saw blade you may not need these helpers, but if you're forgetful or only occasionally use power tools, the push sticks might be a great safety tool for you.

2013 Farmers Insurance Open leaderboard: Tiger Woods storms ...

Tiger Woods shot 5-under in just four holes midway through his second round of play at the Farmers Insurance Open, and now sits three strokes ahead of the pack on the leaderboard.

The old Tiger Woods is on display at Torrey Pines, as he's darted to the top of the leaderboard with a 6-under thus far in the second round that has him three strokes up on his closest competitor.

Woods started the second day at the Farmers Insurance Open at 4-under: respectable, good for 20th place, but not amazing. And he didn't show any fire as he parred his first four holes. Then, he heated up. A birdie on the par-5 14th, then preposterously strong play around the turn, scoring three birdies and an eagle on his eighth-through-11th holes of the day.

Woods sits at 10-under on the leaderboard with seven holes to go on the day, three strokes ahead of a pack consisting of Charles Howell III, KJ Choi, Luke Guthrie, and Luke List.

Tiger won three tournaments last season, putting him close to the top of the PGA Tour Money list, but he hasn't won a major since 2008. Now, thanks to a five-hole hot streak, he's starting off the 2013 campaign strong. SB Nation's Brendan Porath predicted Woods would make a run after his first round of play, and sure enough, he's already on top of the leaderboard.

N.M. teen spends time at church after family slain

ALBUQUERQUE, N.M. (AP) ? The New Mexico teen accused of killing his family and plotting to gun down Wal-Mart shoppers spent much of the day after the early morning slayings at his church, wandering the campus as dozens of Sunday school teachers were being trained on how to deal with a shooter, a security official said.

But it wasn't until hours later, former police officer and Calvary Albuquerque security chief Vince Harrison said, that he knew something had gone terribly wrong.

Harrison, who led the safety training Saturday morning, said he was called back to the church Saturday evening after 15-year-old Nehemiah Griego told a pastor he found his family dead in their home.

"When I met Nehemiah, I knew something wasn't right," Harrison said Wednesday. "I could feel it, I could see it in his eyes and I could see it in his behavior and his demeanor so the red flags went up and that's when I called the sheriff's department."

Harrison, who had known the Griego family for about 10 years, said he drove the teen back to the family's rural southwest Albuquerque home to meet authorities, interviewing him along the way.

"He went into detail of where they were, where the guns were and he was very matter-of-fact, really cold so I knew something wasn't right," Harrison said.

After finding the bodies, sheriff's officials say, they took the teen to headquarters. During questioning, they say he confessed to shooting his mother and three younger siblings in their beds shortly after 1 a.m., then waiting in a bathroom with a military-style semi-automatic rifle to ambush his father upon his return from an overnight shift at a homeless shelter. His father once served as pastor at Calvary.

They say he also told them he had reloaded the family's rifles and taken them with him in the family van with plans to randomly shoot more people.

"That sends chills down my spine," Harrison said. "But obviously God had a different plan."

Harrison said several people spotted Griego at the church Saturday, but thought nothing of it until his arrest. He said officials then reviewed security video and found the teen had spent much of the day there.

He said he doesn't know why Griego decided to come to the church, but that it was like a second home for the boy, who was schooled at his house.

"It was a familiar place to him," Harrison said. "I think if he did have in his mindset to do something foolish and start shooting people there also, I think his demeanor was tamed a little bit because he saw people there he knew."

Sheriff Dan Houston said Tuesday there was no indication Griego intended to harm anyone at the church. The sheriff also said Griego and his girlfriend had spent much of the day together.

A prayer vigil was held at the church Wednesday night for victims Greg Griego, 51, his wife, Sarah Griego, 40, and three of their children ? a 9-year-old boy, Zephania Griego, and daughters Jael Griego, 5, and Angelina Griego, 2.

Before the start of the vigil, members of the crowd shared hugs and handshakes as photographs of the victims were displayed on large digital screens at the front of the church. An estimated 2,000 people attended and nearly every seat was filled before the start of the hour-long service.

"Our hearts break, Lord," Pastor Skip Heitzig told the crowd. "We, often in times like these, scratch our heads and wonder why. We are at a loss for words and we are certainly at a loss for explanation."

Heitzig shared stories about Greg Griego and his family, saying Greg was always ready to "get his hands dirty" and was dedicated to helping others find God through his work as a pastor and a volunteer chaplain. He also urged the crowd to remember that forgiveness and restoration ? two tenets dear to Greg Griego ? will be important as the community moves forward.

Relatives in a statement Tuesday night said they were heartbroken, and remembered the teen as a bright and talented musician who played guitar, drums and bass with the church choir. He also was a champion wrestler who dreamed of following his family's long tradition of military service, and a boy who accompanied his pastor father on rescue missions to Mexico, they said.

"We have not been able to comprehend what led to this incredibly sad situation. However, we are deeply concerned about the portrayal in some media of Nehemiah as some kind of a monster."

The statement, emailed by the boy's uncle, Eric Griego, called on the media and the public not to use 15-year-old Nehemiah Griego "as a pawn for ratings or to score political points."

"He is a troubled young man who made a terrible decision that will haunt him and his family forever," the statement said.
