Court considers Calif. school's May 5 US flag ban

SAN FRANCISCO (AP) — Can the patriotic display of the American flag on domestic soil ever be offensive?

On Thursday, a federal appeals court in San Francisco wrestled with that question after three Northern High school students were sent home from school for displaying the flag on shirts during a Cinco de May celebration in 2010. Administrators feared the patriotic attire would cause disruptions and violence on a campus with a history of racial strife.

The three-judge panel questioned both sides closely and gave no indication how it would rule.

A lower court judge tossed out the students' lawsuit, ruling schools have the authority to limit students' civil rights to ensure campus safety.
